J. Andrew Nathan, Allyson C. Hodges and Marni Nathan Kloster succeeded in persuading the Colorado Supreme Court to overturn a Court of Appeals decision in City of Commerce City v. Enclave West, Inc., 185 P.3d 174 (Colo., 2008). This lawsuit involved a private social club seeking a sexually oriented business license, which was denied by Commerce City’s Council on grounds not initially set forth in the denial letter sent by the city inspector. J. Andrew Nathan and Heidi Hugdahl successfully defended the City at the trial court level. Thereafter, Enclave West was successful in their appeal to the Colorado Court of Appeals. NBDM filed a petition for review by the Colorado Supreme Court. The Colorado Supreme Court reversed the Court of Appeals in Commerce City’s favor. It found that the City Council had a right to review all evidence, not just that contained in the inspector’s licensing denial. This was an important win for municipalities across the state. If the Court of Appeals decision had remained unchallenged, city councils and town boards would have been limited to considering only the information contained in the inspector’s licensing denial. The Supreme Court clarified that new evidence can be considered. This is one of many in a long line of successful appeals on behalf of governmental entities by this firm.
